When does possession occur?

While the closing date is when the sale is finalized and funds are exchanged, it does not automatically confer possession to the buyer. Possession can be delayed until the buyer receives the keys, meaning the buyer does not have the right to occupy the property immediately at closing.

Recording the deed is an important step in the transfer of ownership, but it does not equate to possession. The buyer may technically be recognized as the owner after recording, yet physical possession still requires access to the property, typically granted through receiving the keys.

The seller moving out does not directly correlate with the transfer of possession to the buyer. Although it is common for sellers to vacate before or at closing, the legal possession of the property is formally transferred only when the buyer obtains the keys and is allowed to occupy the residence.
